Antoinetta Fasciale was charged this week with dangerous driving causing death following a collision in March in Bulleen, where the man on the scooter was hit. The man she hit, Donald Johnston, died in hospital that day. Ms Fasciale is also charged with careless driving. Police allege she failed to stop at the line on the road when the traffic light was red. Ms Fasciale, who appeared in court with a handful of family members, is banned from driving under her bail conditions. However defence counsel Darryl Burnett requested her bail be amended so she could take part in a scheduled driving test with VicRoads. Prosecutor Michael Roper did not oppose the application. Ms Fasciale’s bail was altered so the only way she can legally drive is by taking part in lessons under the supervision of VicRoads, or when undergoing a test. Her lawyer also flagged an application to change her bail so Ms Fasciale could one day visit her son and grandchildren in the United States. An overseas holiday had been planned, Mr Burnett said, but was “now not happening”. Ms Fasciale is currently prohibited from travelling overseas and possessing a passport. She must also live at her Bulleen address and not contact prosecution witnesses as part of her bail conditions. Magistrate Tara Hartnett extended bail for the accused woman to return to court in August.
