Eileen Jolly sued the NHS trust where she worked for 25 years after her career ended at the age of 85. She was blamed for not uploading details of women awaiting non-urgent breast reconstruction surgery to a new database. An employment tribunal ruled she had not been trained properly and was the victim of unfair dismissal and discrimination.

A blistering report into the NSW health system’s failure to appropriately manage scores of complaints against a gynaecologist has found the system failed to protect the women in his care. The report, by Gail Furness SC, reviewed the management of complaints by NSW Health made against Emil Gayed between 1994 and 2017 when his registration was suspended, effectively banning him from practicing medicine. The inquiry examined complaints management and processes in the public health system at five hospitals across NSW. In a statement, the department said the report would be provided to police for investigation and to consider prosecution. No complaints were recorded against him during his time at Grafton or Kempsey hospitals, however scores of patients and hospital staff registered complaints against him during his time at Manning Base Hospital in Taree, Mona Vale Hospital on Sydney’s northern beaches, and Cooma Hospital in the state’s south. The report found that almost every year between 1999 and 2016 a concern was raised about Dr Gayed’s practice.
