Aged Care Services Australia Group Pty Ltd T/A Elanora Aged Care has been ordered by the Fair Work Commission to pay $4,500 to an employee it unfairly dismissed. Edao Raya was employed by Aged Care Services Australia Group Pty Ltd (ACSAG) from 24 May 2012. He says his employment was terminated unfairly on 17 March 2015. He was employed as a personal care worker. The Facility Manager received a delayed complaint from one of Mr Raya’s co-workers that he had mistreated two residents of the facility on 6 March 2015. He was suspended on full pay whilst the complaint was investigated. The allegations were also referred to Victoria Police and the Department of Human Services. The case against Raya failed because ACSAG failed to call the complainant (Ms Karyn Dais) to give evidence, no other staff witnessed the alleged assaults and the police complaint was unsigned.
