A s.604 (Appeal of decisions) by Australian Nursing and Midwifery Federation against Uniting Church in Australia Property Trust (Q); Australian Workers Union and the United Workers Union has been agreed in part. Deputy President Gostencnik, Deputy President Masson and Commissioner Lee in Melbourne on 3 March 2020 said “We are satisfied that it is in the public interest that permission to appeal be granted in respect of ground 3 of the notice of appeal because the ANMF has made out an arguable case of appealable error in respect of that ground and because there is appealable error as we have identified. We consider there is public interest in ensuring that the agreement approval requirements about which the Commission must be satisfied are properly considered and administered. We therefore grant permission to appeal in respect of ground 3.”
